What is a mobile food vendor?

    A mobile food vendor is the operator of a business involving the sale of food or beverages from a vehicle (within the meaning of the Road Traffic Act 1961).

    SA Government’s new legislation

    As from 1 March 2018, new SA Government legislation will allow for mobile food vendors to apply to Council for a permit under Section 222 of the Local Government Act 1999, to operate a mobile food vending business within the Council area.

    Under this legislation, subject to the regulations, a Council must grant a permit for the purpose of a mobile food vending business, however, through the adoption of ‘location rules’ Council will be able to set conditions on where vendors will be able to trade.

    The location rules must be consistent with any requirements prescribed by the Local Government (General) (Mobile Food Vendors) Variation Regulations 2017.

    How will this be introduced in Victor Harbor?

    In the City of Victor Harbor, nine locations have been selected for a trial period from
    1 March 2018 to 1 March 2019. During the trial each site will be monitored for any impact that may affect the suitability of the site. The community is also invited to provide their feedback on the suitability of the sites. Feedback can be provided using the online feedback at www.yoursay.victor.sa.gov.au/mobilefood or by collecting a feedback form from the council office at 1 Bay Road, Victor Harbor.

    Where are the trial locations?

    The locations for the mobile food vendor trial include:

    ·  Corner of Inman Street and Esplanade

    ·  Youth Park (Bridge Terrace)

    ·  Bridge Point

    ·  Hayward Court Lookout

    ·  Investigator Car Park

    ·  Hindmarsh Falls

    What considerations were made when choosing the trial locations?

    When determining the locations and the ‘location rules’ that a mobile food vendor may operate, Council considered the balance between:

    ·  A reasonable distance from fixed food businesses during the operating hours of the fixed food business

    ·  The location, number and operating hours of fixed food business

    ·  The effect on vehicle and pedestrian traffic, footpaths, driveways, access points to buildings and parking areas for people with disabilities

    ·  The requirement relating to, and availability of, parking spaces at the locations in  which mobile food vending businesses may operate under the location rules

    ·  Residents and businesses at the locations in which mobile food vending businesses may operate under the location rules.

    I am a mobile food vendor. Do I have to apply to set up at the trial locations?

    Yes. Mobile food vendors are required to seek Council’s permission by submitting an application.

    Does this trial apply for festivals, events and private functions?

    These guidelines to not include applications for mobile food vendors that wish to trade at Festivals and Events (or to Mr Whippy type ice-cream vans, no Permit required).

    A Permit is not required if the mobile food vendor is catering (by invitation) for an event on public land where a Permit or Licence has already been issued to the Event Holder.
