The City of Victor Harbor is seeking public feedback on a proposal to enter into a licence agreement with Wohlers Properties Pty Ltd (Wohlers). The proposed licence would authorise occupation of a portion of the gabion retaining wall encroaching onto Council land located at Lot 99 Hindmarsh Road, McCracken.

The portion of Lot 99 relevant to this licence and thereafter to be purchased by Wohlers measures approximately 160 metres in length and 1.3 metres in width for a total of 205 square metres.

The purpose of the interim licence is to authorise the occupation of the subject land until the land is acquired at market value by Wohlers.

To aid in the preparation of the licence agreement with Wohlers, the community is invited to comment on the following principles:

  • The licence to expire 12 months from the commencement date or on the transfer of the subject land to the licensee, whichever is earlier.
  • The licenced area measures 205 square metres of land on which the gabion retaining wall encroaches onto Lot 99 Hindmarsh Road, McCracken.
  • The licence fee be a peppercorn rental at $1.00 on demand.
  • The licensee being responsible for the maintenance of the retaining wall.
  • The licensee being responsible to maintain public liability insurance over the subject land.
